Lutter Terms of Use
1. Agreement
These Terms of Use ("Terms") govern your use of the Lutter iOS app ("Lutter", "the App") provided by xup Studio ("we", "us"). By installing or using Lutter you agree to these Terms together with Apple's Standard End User License Agreement, which also applies to your use of the App. If you do not agree, please do not install or use Lutter.
2. License
We grant you a personal, non-transferable, non-exclusive, revocable license to install and use Lutter on Apple-branded devices that you own or control, subject to these Terms and the Apple Standard EULA.
3. Pricing and in-app purchases
- Free: Lutter is free to install and use with a limited feature set.
- Pro (USD $24.99, one-time purchase): Unlocks all professional features for the Apple ID that purchased it. No recurring charge.
- Lutter Pass (USD $1.99 per month, subscription): Provides monthly new LUT content. The first month is offered free as an introductory offer (where applicable). The subscription auto-renews monthly until cancelled. You can cancel at any time in App Store → Apple ID → Subscriptions.
All purchases are processed by Apple. Local prices may vary by region and currency conversion.
4. Refunds
Refunds for any in-app purchase or subscription are handled by Apple. To request a refund, visit reportaproblem.apple.com.
5. Acceptable use
- Do not reverse engineer, decompile, disassemble, or attempt to extract the source code of the App, except to the extent expressly permitted by applicable law.
- Do not redistribute, resell, or sublicense the LUTs we ship with the App.
- Do not use Lutter for any unlawful purpose or in violation of any applicable laws.
6. Your content
You retain all rights to videos you import into Lutter and to the edits, projects, and custom LUT files you create. We do not claim ownership over your content. Because Lutter processes everything on-device and does not upload your videos, we never have access to your content.
7. Intellectual property
The Lutter app, its name, logo, design, source code, and the LUTs that we author are owned by xup Studio. Some bundled LUTs originate from third-party sources licensed under Creative Commons CC0; those LUTs are redistributable under their original license. Open-source components used by Lutter are listed in the App's Settings → About.
8. Cinema Looks — trademark and attribution disclaimer
Lutter's Cinema Looks feature uses public color science to algorithmically emulate the look of professional cinema cameras. The names ARRI, ALEXA, RED, HELIUM, Sony, Venice, S-Log3, and Blackmagic Design (BMPCC) are trademarks of their respective owners. xup Studio is not affiliated with, endorsed by, or sponsored by any of these manufacturers. The Cinema Looks feature is provided for creative reference only and is not a calibrated reproduction of any specific camera's color science.
9. No warranty
Lutter is provided "AS IS" and "AS AVAILABLE", without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the App will be uninterrupted or error-free, or that color-grading or stabilization output will meet professional broadcast specifications. Always keep backup copies of important footage before processing.
10. Limitation of liability
To the maximum extent permitted by applicable law, in no event shall xup Studio be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from your use of or inability to use the App. Our total liability for any direct damages shall not exceed the amount you paid for the App within the 12 months preceding the claim.
11. Apple as third-party beneficiary
You acknowledge that these Terms are between you and xup Studio, not with Apple, and that xup Studio (not Apple) is solely responsible for the App and its content. Apple and its subsidiaries are third-party beneficiaries of these Terms and, upon your acceptance, will have the right to enforce these Terms against you as a third-party beneficiary.
12. Governing law
These Terms are governed by the laws of the Republic of China (Taiwan), without regard to its conflict of law principles. Any dispute arising out of or relating to these Terms shall be submitted to the Taiwan Taipei District Court as the court of first instance, unless mandatory consumer protection law in your country of residence requires otherwise.
13. Changes to these Terms
We may update these Terms from time to time. We will update the Effective date above. Continued use of the App after changes constitutes acceptance of the updated Terms. Material changes will be announced inside the App on the next launch.
